AN ACT TO AMEND TITLE 11, DELAWARE CODE, SECTION 1906 RELATING TO POWERS OF POLICE OFFICERS TO ARREST FOR SHOPLIFTING WHEN SUCH AN ARREST IS FOR A MISDEMEANOR.
Be it enacted by the General Assembly of the State of Delaware:
Section 1. Title 11, Delaware Code, Section 1906 Is amended by striking the period at the end of subpart (2) of subsection (a) thereof and inserting thereof ";or" and by adding a new subpart (3) to read as follows:
"(3) out of his presence and within the State for the crime of shoplifting and the arrest is based upon personal investigation at the scene of arrest and where a store employee is present who has observed the activity of the person to be arrested and that person is still present."
