AN ACT TO AMEND CHAPTER 39, TITLE 10, DELAWARE CODE, BY THE ADDITION THEREOF OF A NEW SECTION ABOLISHING CAUSES OF ACTION FOR ALIENATION OF AFFECTIONS, CRIMINAL CONVERSATION, SEDUCTION, ENTICEMENT AND BREACH OF CONTRACT TO MARRY.
Be it enacted by the General Assembly of the State of Delaware:
Section 1. Chapter 39, Title 10, Delaware Code, is amended by adding thereto a new Section 3924 to read as follows:
§ 3924. Causes of action for alienation of affections, criminal conversation, seduction, enticement and breach of contract to marry abolished
The rights of action to recover sums of money as damages for alienation of affections, criminal conversation, seduction, enticement, or breach of contract to marry are abolished. No act done in this State shall operate to give rise, either within or without this State, to any such right of action. No contract to marry made or entered into in this State shall operate to give rise, either within or without this State, to any cause or right of action for its breach.
Section 2. This Act shall become effective on the day it is enacted into law but shall not affect any action filed prior to the effective date or any action filed within 90 days after the effective date for any cause of action accruing prior to the effective date.
Section 3. If any provision of this Act or the application thereof to any person or circumstances is held invalid, the invalidity shall not affect other provisions or applications of the Act which can be given effect without the invalid provisions or application, and to this end the provisions of this Act are severable.
