AN ACT TO AMEND CHAPTER 9, TITLE 10 OF THE DELAWARE CODE RELATING TO THE EXCLUSIVE ORIGINAL CRIMINAL JURISDICTION OF THE FAMILY COURT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend Section 922, Chapter 9, Subchapter II, Title 10 of the Delaware Code by inserting in section 922(a) after the words "(a) Except as provided in subsection (b)" and before the words "of this section" the following.
and (c)"
Section 2. Amend Section 922, Chapter 9, Subchapter II, Title 10 of the Delaware Code by adding a new subsection (c) as follows:
"(c) Notwithstanding the provisions of subsections (a)(1), (a)(2), (a)(3), (a)(18) and (a)(21) of this section, if offenses or criminal cases within the exclusive original jurisdiction of Family Court otherwise may be joined properly with a felony within the jurisdiction of Superior Court, such offenses or criminal cases shall be within the jurisdiction of Superior Court."
