CHAPTER 90
STATE BOARD OF PHARMACY DUTIES OF OFFICERS AND FEES CHARGED
AN ACT TO AMEND CHAPTER 28 OF THE REVISED CODE OF DELAWARE, 1935, AS AMENDED, ENTITLED "STATE BOARD OF PHARMACY", WITH REFERENCE TO THE SECRETARY, INSPECTOR, AND OTHER EMPLOYEES THEREOF, THEIR DUTIES AND COMPENSATION AND TO FEES CHARGED AND COLLECTED.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That Chapter 28 of the Revised Code of Delaware, 1935, be amended by striking out and repealing the first paragraph of 937. Sec. 2 thereof and enacting and inserting in lieu thereof a new first paragraph as follows:
937. Sec, 2. Organization; Secretary's Bond; Meetings:--Annually the State Board of Pharmacy shall organize by the election of a President and Secretary, both of whom shall hold their offices for one year, and until their successors shall have been elected and qualified. The President shall be a member of the Board.
Section 2. That Chapter 28 of the Revised Code of Delaware, 1935, be amended by striking out and repealing the first paragraph of 939. Sec. 4. thereof and by enacting and inserting in lieu thereof a new first paragraph as follows:
939. Sec. 4. Compensation of Secretary, Inspector, Agent, Representative and Members; Fees and Fines, How Disposed of; Annual Appropriation; Compensation, How Paid:--The Secretary, Inspector, Agent and Representative of the Board shall receive such compensation as may be prescribed by the Board and his or their necessary expenses while engaged in the performance of his or their official duties. The members of the Board shall receive the sum of Ten Dollars ($10.00) for each day actually employed in the discharge of their official duties and their necessary expenses while engaged therein, provided that no member shall receive in any event more than Three Hundred Dollars ($300.00) per annum, but such limitation shall not apply to the Secretary of the Board should a member thereof be selected to fill that position.
Section 3. That Chapter 28 of the Revised Code of Delaware, 1935, as amended by Chapter 95, Volume 43, Laws of Delaware, be further amended by striking out and repealing 948. Sec. 13. and enacting and inserting in lieu thereof a new Section to be styled 948. Sec. 13. as follows:
948. Sec. 13. Fees; When Payable:--The Board of Pharmacy shall charge and collect the following fees:
For examination for license as Pharmacist, $15.00 and $10.00 additional for certificate.
For examination for license as Assistant Pharmacist, $10.00 and $5.00 additional for certificate.
For reciprocal registration, $25.00.
For renewing the license of a Pharmacist, $10.00.
For renewing the license of an Assistant Pharmacist, $5.00.
For annual renewal of permit to operate a drug store, $25.00 and for change of location, $1.00.
For issuing permit for new store or change in ownership, $25.00.
For annual renewal of permit to manufacture, $2.00.
All fees shall be paid before any applicant may be admitted to examination or his name placed upon the register of Pharmacists or Assistant Pharmacists, or before any license, or any renewal thereof, may be issued by the Board.
Section 4. That Chapter 28 of the Revised Code of Delaware, 1935, as amended by Chapter 87, Volume 41, Laws of Delaware, be and the same is hereby further amended by striking out and repealing the second paragraph of 956D. Sec. 25. thereof and enacting and inserting in lieu thereof a new second paragraph as follows:
The State Board of Pharmacy be and it is hereby authorized and empowered to employ such agent or agents, representatives, and inspector or inspectors as may be necessary to give effect to the provisions of this paragraph and to assure the proper enforcement of the other provisions of this Chapter, and to prescribe their duties.
