AN ACT TO AMEND TITLE 1 OF THE DELAWARE CODE RELATING TO BILL AND AMENDMENT DRAFTING.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §109(d) Chapter 1 of Title 1 of the Delaware Code by deleting the second sentence which reads: "In such case, the amendment shall be made by stating specifically the manner in which the section is to be amended: i.e., the amendment should state that a specified section is amended by striking out the words which it is desired to change (stating their location in the section) and substituting thereof the new words." and substituting in lieu thereof the following:
"Any bill or amendment which amends an existing statute or bill shall set out in full that part of the statute or bill, sections or subsections, to be amended and shall indicate the words to be deleted by strike through and shall indicate new words by underlining."
Section 2. The Act shall become effective January 1, 2012.
Section 3. Amend §109(d) Chapter 1 of Title 1 of the Delaware Code by designating the existing subsection as paragraph (d) (1) and by adding an additional paragraph to read as follows:
"(2) The provisions of paragraph (1) shall not be applicable to the annual operating budget, capital improvements budget and grants in aid legislation. Such legislation shall have attached a side-by-side comparison of prior year appropriations and appropriations contained within the legislation, along with a corresponding comparison of authorized positions. However, all other provisions of this section shall remain applicable to appropriations legislation.".
Section 4. This Act shall not apply to any amendment introduced on or after January 1, 2012 to a bill introduced prior to January 1, 2012.
