AN ACT MAKING APPROPRIATIONS FOR CERTAIN GRANTS-IN-AID FOR THE FISCAL YEAR ENDING JUNE 30, 2002; SPECIFYING CERTAIN PROCEDURES, CONDITIONS AND LIMITATIONS FOR THE EXPENDITURE OF SUCH FUNDS; AMENDING THE FISCAL YEAR 2002 APPROPRIATIONS ACT; AND AMENDING CERTAIN PERTINENT STATUTORY PROVISIONS.

(2) For Fiscal Year 2001 a calculation was made to determine the increase that the New Castle County Volunteer Fire Companies received for the insurance premium tax in FY 2000 vs FY 1999. That amount was added to the base allocation to each Volunteer Fire Company in Kent and Sussex Counties. (The base represents $22,401 included in the Fiscal Year 1999 Grant-in-Aid Appropriation Bill.) For each subsequent fiscal year, a similar calculation will be made and if there is an increase from one fiscal year to the next fiscal year, that amount will be added to the $22,401 base to become the amount to be paid for that fiscal year. At no time will the amount for Kent and Sussex Volunteer Fire Companies be less than the base amount of $22,401.

(d) The sum of $8,116 is hereby appropriated to the American Legion, Department of Delaware, for the bearing of expenses incident to the holding of Boys' State.
(e) The sum of $8,116 is hereby appropriated to the American Legion Auxiliary, Department of Delaware, for the bearing of expenses incident to the holding of Girls' State.
(f) The sum of $3,242 is hereby appropriated to the American Legion, Department of Delaware, for the bearing of expenses incident to the holding of Trooper Youth Week in conjunction with the Delaware State Police.
(g) The funds appropriated by this Section shall be paid to the Finance Officer of the respective veterans' organizations, upon warrants signed by the proper Finance Officer and approved by the Secretary, Department of Finance.

Section In order to be considered for a Grant-in-Aid Appropriation under Section 1 or Section 2 of this Act, an agency must meet the following criteria:
1. Be incorporated, non-profit (or under umbrella of parent organization which is incorporated, non-profit);
1. Have By-laws that clearly state the purpose of the Corporation and include definition of duties of Board of Directors;
1. Have an active, community-represented, volunteer Board of Directors that sets policies, goals and objectives, and maintains minutes of regularly scheduled meetings and any special meetings;
1. Have programs that are unduplicated by other state supported agencies and satisfy unmet human needs of the community; Have personnel policies including job descriptions and classifications;
1. Employ no member of the General Assembly on a salaried basis or in exchange for any emolument. Any elected official who was employed by an organization which received a Grant-in-Aid prior to their election shall be exempt from this provision;
1. Have competent executives, competent staffing and reasonable facilities;
1. Practice non-discrimination;
1. Have accounting (budget) procedures and an annual audit;
1. Use funds in accordance with the application;
1. Demonstrate community support;
1. Request funds only for a program which does not receive full funding from other sources of revenue.
Section (a) No funds appropriated in this Act shall be expended in a political campaign or for partisan political purposes.
(b) No funds appropriated in this Act may be used to hire lobbyists.
Section The Controller General may from time to time contract for or conduct performance and/or financial audits of any non-state agency for which funds are appropriated in this Act.
Section Funds appropriated in this Act shall not be used by any agency to provide child day care. It is the intent of the General Assembly that no funds will be appropriated in Fiscal Years 2002 and 2003 in grants-in-aid to agencies for the purchase of capital equipment, relocation, rehabilitation, renovation or purchase of buildings. Organizations will not be eligible for consideration of a grant-in-aid appropriation unless they have been incorporated and operating for a two-year period prior to June 30th of the fiscal year in which they apply for funding for the following fiscal year.
Section Paragraph 29 Del. C. (d), Chapter 65, Title 29, Delaware Code, provides that monies appropriated for grants-in-aid in Fiscal Year 2002 shall be paid in quarterly installments. For Fiscal Year 2002, such payments will be made on July 25, October 1, January 1, and April 1. Upon notification by the Chairman of the Joint Finance Committee, the State Treasurer shall be directed to withhold such installment payment(s). An installment payment may be delayed or withheld if the grant-in-aid recipient because of, but not limited to, the following:
(a) Has not submitted a quarterly statement of expenditures if required to do so;
(b) Expended funds from the grant-in-aid for purposes not intended by the General Assembly;
(c) Expended funds for day care, purchase of capital equipment, relocation, renovation, rehabilitation or purchase of buildings;
d(d) Failure to pay Corporation Franchise Tax; and
e(e) Agency is no longer in operation.
(f) In the case of a senior center closing during the fiscal year, any remaining quarterly payments will be retained in the Office of the Controller General. Disbursements from this account shall be made in consultation with the University of Delaware and with the approval of the co-chairs of the Joint Finance Committee.
Section (a) It is the intent of the General Assembly that each Grant-in-Aid recipient shall submit one of the following with its application for a grant award in Fiscal Year 2003:
(i) An audit prepared by a Certified Public Accountant covering the prior full fiscal year of the receiving agency, or
(ii) Balance Sheet reflecting total Assets, Liabilities, and Fund Balances covering the prior fiscal year of the receiving agency; Statements of Support, Revenue and Expenses and Changes in Fund Balances covering the prior fiscal year of the receiving agency; and Statements of Functional Expenses covering the prior fiscal year of the receiving agency.
(b) Fire companies listed in this Act shall submit financial information on the form approved by the State Treasurer, the Budget Director and the Controller General. The listed fire companies are exempt from the provisions of Subsection (a) of this Section.
(c) Recipients of the appropriations for Aid to Local Law Enforcement shall be exempt from the provisions of this Section.
(d) Non-compliance by a Grant-in-Aid recipient with the provisions of this Section shall automatically disqualify the applicant for consideration of a Grant-in-Aid award in Fiscal Year 2003.
(e) For Fiscal Year 2002, it is the legislative intent that a Grant-in-Aid recipient listed in Sections 1 or 2 of this Act shall not be entitled to receive any of the funds appropriated by this Act unless certain financial information has been received by the Office of the Controller General on or before July 25, 2001. Such financial information shall be in the form as defined in Subsection (a)(i) or Subsection (a)(ii) of this Section covering full fiscal year of the receiving agency. If any Grant-in-Aid recipient fails to comply with this Subsection (e) the funds appropriated by this Act to that recipient shall revert to the General Fund of the State.
Section This Act is a supplementary appropriation and the monies appropriated shall be paid by the State Treasurer from General Fund monies not otherwise appropriated. Any funds remaining unexpended or unencumbered by the State Treasurer as of June 30, 2002, shall revert to the General Fund of the State of Delaware.
Section The sums appropriated to the various Senior Centers in Section 1 of this Act shall be made available to the Division of Services for Aging and Adults with Physical Disabilities in order to meet the State's matching requirement for federal funds appropriated under the Older Americans Act of 1965, as amended. Those senior centers receiving funds under the Older Americans Act of 1965, as amended, shall present to the Division of Services for Aging and Adults with Physical Disabilities a proposal for expenditure of State funds. The proposal submitted to the Division of Services for Aging and Adults with Physical Disabilities shall be prepared in accordance with the guidelines established for the administration of programs under the Older Americans Act. To be considered for funding a senior center must meet the criteria established in Section 5. Funding will be determined by the Joint Finance Committee based upon its evaluation and with advice from the University of Delaware Institute for Public Administration.
Section Section 1 of this Act makes an appropriation to the Department of Health & Social Services, Public Health, Emergency Medical Services (35-05-30), for the state component of the operational costs associated with each county's paramedic service for Advanced Life Support. These funds shall be disbursed by Emergency Medical Services on a quarterly basis to counties that operate approved programs.
Emergency Medical Services shall have an audit performed by the State Auditor annually to insure that reimbursement to the counties for the State share of costs was for approved Advanced Life Support Services. Adjustments shall be made to the final quarterly reimbursement based on the audit results.
Section For Fiscal Year 2002, the remaining balance in the Fiscal Year 2001 account (35-05-30-09-77) shall remain as a continuing appropriation and shall not be subject to reversion until June 30, 2002.
Section Appropriations made in Section 1 of this Act to Emergency Medical Services and Aid to Local Law Enforcement shall not be subject to the provisions in Sections 8, 9 and 10. Funds appropriated to Aid to Local Law Enforcement shall not be subject to reversion at the end of the fiscal year if unexpended or unencumbered, but shall be continued for a period of up to three years.
Section For Fiscal Year 2002, direct paramedic initial training, recertification training and testing for the Statewide paramedic program shall be offered at a single site.
Section (a) The funds appropriated in Section 2 for the Department of Public Safety - Aid to Local Law Enforcement shall be allocated according to the formula presently used by the SALLE Committee as revised from time to time. Expenditures from this fund must be approved by the Budget Director and the Controller General.
(b) Local law enforcement agencies may combine their allocations, upon approval of the SALLE Committee, to support a pool arrangement to fund a contiguous area served by more than one local law enforcement agency.
(c) Each local law enforcement agency contracting for an allocation shall, not later than April 1, 2002, report in detail the plan under which such funds are being expended, and any other information requested by the SALLE Committee. The SALLE Committee shall report to the General Assembly of the State of Delaware on or before May 1, 2002, as to the agencies that were awarded grants from these funds, the amount of the grant, and the purpose of the grant.
(g) Copies of the minutes of all regular meetings and any special meetings of the SALLE Committee shall be forwarded in a timely manner to the Office of the Controller General.
Section Section 1 of this Act appropriates funds to Aid to Local Law Enforcement. These funds shall be distributed based on (a) $3,000 to each police agency; (b) any funds in excess of "(a)" based on the ratio of the number of police officers each police agency has to the total number of police in all agencies.
Section Amend 11 Del. C. §4113(a) by striking the words "authorization by the Attorney General" and inserting in lieu thereof the words "authorization by the Attorney General, the Budget Director and the Controller General".
Further Amend 11 Del. C. §4113(a) by adding the to end of said subsection the following sentence:
"Guidelines for appropriate uses of the fund shall be established by the Attorney General with the concurrence of the Budget Director and the Controller General."
Section Amend 11 Del. C. §4113(c) by striking the words "the Attorney General may authorize" as they appear in said subsection and inserting in lieu thereof the words "the Attorney General, with the concurrence of the Budget Director and the Controller General, may authorize."
Section Amend 11 Del. C. §1511(a) by deleting the words "for the use by the State for any purpose deemed by the Attorney General to be in the interest of law enforcement" as they appear in said subsection.
Section (a) The State Treasurer is authorized to take the necessary steps to make a total payment of the appropriation in Section 2 of this Act at the beginning of the first quarter of Fiscal Year 2002 for the agencies as follows:

(b) The State Treasurer is authorized to take the necessary steps to make a total payment of the appropriation in Section 1 of this Act at the beginning of the first quarter of Fiscal Year 2002 for the municipalities which receive $6,000 or less from the line item Aid to Local Law Enforcement.
(c) The State Treasurer is authorized to take the necessary steps to make a total payment of the appropriation to any Grant-in-Aid recipient receiving an amount of $6,000 or less listed in Section 2 of this Act at the beginning of the first quarter of Fiscal Year 2002.
(d) The State Treasurer is authorized to take the necessary steps to make a total payment of the appropriation to fire companies listed in Section 3 of this Act at the beginning of the first quarter of Fiscal Year 2002.
Section Section 2 of this Act makes an appropriation to the Office of the Controller General (01-08-02) as a one-time item for “Senior Center Projects”. These funds may be used to provide supplemental funding to support the reorganization of senior centers in New Castle County and to fund new senior centers that may open during Fiscal Year 2002. Expenditures for such programs must be approved by the co-chairs of the Joint Finance Committee. Any remaining funds may be used to provide senior centers with seed money to implement innovative collaborative programs for senior citizens.
Section Section 2 of this Act makes an appropriation to the Office of the Controller General – Senior Center Projects. Of that amount, $100.0 shall be for the Child Advocacy Center. The Budget Director and the Controller General are hereby authorized to transfer this amount to the Department of
Services for Children, Youth and Their Families, Division of Family Services, Office of the Director
(37-06-10) to the line item "Pass Throughs".
Section Section 2 of this Act makes an appropriation to the Delaware State Fair. Of that amount, $100,000 shall be used for prizes for achievements in agriculture, animal raising and in works of manual training and the domestic arts to be awarded at the annual State Fair and shall be paid by the State Treasurer at the beginning of the first quarter of Fiscal Year 2002. Of the remaining $60,650, $5,000 shall be used for purses on Governor’s Day and the remaining $55,650 shall be paid in quarterly allotments, as provided in Chapter 65, Section 6505 of Title 29, Delaware Code.
Section The appropriation in Section 2 of this Act to Camp Barnes, Inc. shall be used for the purpose of maintaining and operating Camp Barnes for the recreation of deserving youths from throughout the State.
Section Section 2 of this Act appropriates funds to Eastlawn Area Human Services, Inc. None of these funds, nor any Federal, State or Local Government funds, shall be expended for the purchase of television, cable TV and/or radio broadcasting services.
Section Section 2 of this Act appropriates funds to the Delaware State Police Museum, Inc. These funds may not be used for capital/construction costs.
Section For Fiscal Year 2002, the Bridgeville Senior Center shall submit to the Joint Finance Committee on September 15, 2001, December 15, 2001, and March 15, 2002, a report reflecting income and expenditures for the Fiscal Year 2002, and average daily attendance at the senior center or senior
center activities.
Section Section 2 of this Act makes an appropriation to the Elsmere Recreation, Inc. Of this amount, $15,000 shall be used to support the Elsmere Boxing Club.
Section Section 2 of this Act makes an appropriation to “Slam Dunk to the Beach” – National Holiday Basketball Invitation. Of that amount, $500 in scholarships shall be made available to each team participating in the annual tournament. A separate account shall be maintained for scholarship funds.
Section Slam Dunk to the Beach shall submit a plan outlining its proposed scholarship program for FY 2002, the amount of anticipated scholarship awards, and funding sources for said scholarships. This information shall be provided to the Co-Chairs of the Joint Finance Committee and Controller General by December 1, 2001. Slam Dunk to the Beach shall also submit actual scholarships provided during FY 2002 by March 1, 2002 to the Co-Chairs of the Joint Finance Committee and the Controller General.
Section Section Two of this Act makes a one-time appropriation of $10,751 to the Addictions Coalition. This appropriation is to be used to reimburse the Grace Episcopal Church on Concord Pike, Wilmington for rent and utilities.
Section Section 2 of this Act appropriates $31.0 to One-Time Items, Office of the Controller General - Fox Point Park. These funds shall be used for consultant services to coordinate the path forward with respect to improvements at Fox Point State Park.
Section Section Four of this Act makes an appropriation to the organization formerly known as AMVETS. This appropriation will be held in by the State Treasurer until such time the organization provides documentation to the Controller General that they have obtained an affiliation with a national veterans organization and employ a duly selected service officer.
Section Amend Section 8(a)(i) of HB 350 of the 141st General Assembly (FY 2002 Budget Bill) by adding to the list of 40 hour workweek employees the following:
"Health & Social Services Drug Control and Enforcement Agents
Chief Drug Control and Enforcement
Drug Control Administrator".
Section Amend Section 422 of the Fiscal Year 2002 Appropriations Act (House Bill 350 of the 141st General Assembly) by adding the following after the last sentence of such section: “ If the implementation of such rules and regulations result in fewer than 150 scholarships being awarded at either grade 8 or grade 10 for either the highest scores on the DSTP without reference to any other indicators of performances, or the highest scores on the DSTP who participate in free and reduced lunch programs, the Department of Education is authorized to award additional scholarships. Such additional scholarships shall be awarded to students scoring at the next qualifying level by priority order of Reading, Math and Writing. Such additional awards shall be granted by priority curriculum area until no more awards can be made without exceeding the 150 limit previously specified.”
Section All functions, responsibilities, and duties performed by Telephone Services pursuant to 29 Del. C. § 8811(a)(1), shall now be performed by the Office of Information Services. This transfer shall become effective July 1, 2001.
Section Amend Section 39(a) of the Fiscal Year 2002 Appropriations Act (House Bill 350 of the 141st General Assembly) by adding the following “2001 (10-02-06-0-96) Budget Commission”.
Section Amend Section 326 (a) of House Bill 350 of the 141st General Assembly (FY 2002 Budget Act) by striking the figure "$2,540" as it appears therein and substituting in lieu thereof the figure "$2, 373.9".
Section Amend Section 10, page 84, line 8 of HB 350 of the 141st General Assembly by striking the figure "83.1" as it appears next to the title "Chief Engineer" and inserting in lieu thereof the figure "98.0".
Further Amend Section 10, page 84, line 9 of HB 350 of the 141st General Assembly by striking the figure "98.0" as it appears next to the title "Director- Administration" and inserting in lieu thereof the figure "83.1".
Further Amend Section 10, page 81, line 15 of HB 350 of the 141st General Assembly by striking the figure "68.2" as it appears next to the title "State Librarian" and inserting in lieu thereof the figure "73.7".
Section Amend Section 150 of HB 350 of the 141st General Assembly by adding to the end of said section the following:
"(d) If Senate Bill 235 of the 141st General Assembly or similar legislation is not enacted into law, this entire section shall be repealed."
Section Amend House Bill No. 350 of the 141st General Assembly (FY 2002 Budget Act) by adding an additional section at the end of said bill to read as follows:
"Section 428. Section 1 of this Act provides Appropriated Special Fund appropriations to the Department of Services for Children, Youth and Their Families, Division of Family Services, Office of the Director (37-06-10) for the Child Abuse Registry. It is the intent that appeals and petitions to Hearing Officers for expungement for persons on the Central Child Abuse Registry be on a contractual basis.
Further, the Budget Director and the Controller General shall execute necessary adjustments during FY 2002 to effectuate this initiative on a contractual basis."
Section Amend Section 326 (a) of House Bill 350 of the 141st General Assembly (FY 2002 Budget Act) by striking the figure "$2,540" as it appears therein and substituting in lieu thereof the figure "$2, 373.9".
Section . Amend Section 39 (a) of House Bill No. 350 of the 141st General Assembly of the (Fiscal Year 2002 Appropriations Act) by adding the following:
"2001 (35-14-10-09-78) Senior Centers".
Section 46. Amend House Bill No. 350 of the 141st General Assembly (FY 2002 Budget Act) by adding an additional section at the end of said bill to read as follows:
“Section 429 Notwithstanding any other law to the contrary, the Employee Benefits Committee, subject to the approval of the Budget Director and the Controller General, is authorized to transfer funds between the employee benefit accounts for which it has control and management pursuant to 29 Del. C. Sec. 9602.”
