AN ACT TO AMEND TITLE 12 OF THE DELAWARE CODE RELATING TO ESCHEATS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Title 12 of the Delaware Code, Section 1198(9)a by striking the comma “,” immediately following the word “property” as the same appears for the second time in the first sentence of the existing subsection and inserting in lieu thereof a period “.”; and by striking all the remaining language immediately following the aforesaid comma “,” beginning with the word “providing” to the end of the sentence; and by inserting in lieu thereof the following new sentence:

“Notwithstanding the forgoing, “period of dormancy” means the full and continuous period of 3 years with respect to intangible ownership or indebtedness in a corporation or other entity whether or not represented by a stock certificate or other certificate of membership, bonds and other securities including fractional shares, interest, dividends, cash, coupon interest, liquidation value of stocks and bonds, funds to redeem stocks and bonds, and distributions held by financial intermediaries.”

Section 2. Amend Title 12 of the Delaware Code, Section 1198(9)b by adding the quoted language immediately

following the word “corporation” as the same appears therein:

“partnership, statutory or common law trust, limited liability company, or other entity”
