AN ACT TO AMEND CERTAIN PROVISIONS OF SECTION 8-200(5) OF THE CITY OF WILMINGTON HOME RULE CHARTER.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

WHEREAS, Section 8-200 of the City’s Home Rule Charter sets forth bidding procedures for purchases and contracts generally, which procedures are categorized by the dollar amount of the expenditure for the contract or purchase; and

WHEREAS, it is in the best interests of the citizens of Wilmington to increase the dollar amounts of the respective categories of expenditures which determine the bidding procedures for contracts and purchases.

NOW THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Section 8-200 of the Wilmington City Code by deleting the understricken language and adding the underlined language to read as follows:

Wilmington City Charter, Sec. 8-200. Purchases and Contracts Generally.

(2) If any purchase or contract for which competitive bidding is required involves an expenditure of [more than one] five thousand dollars [($1,000.00)] ($5,000.00) or more, but less than [ten] twenty-five thousand dollars [($10,000.00)] ($25,000.00), the procurement and records division shall obtain quotations from at least three (3) vendors or contractors for the items to be purchased or contract to be performed.

(3) If any purchase or contract for which competitive bidding is required involves an expenditure of [more than ten] twenty-five thousand dollars [($10,000.00)] ($25,000.00) or more, but less than [sixty] one hundred thousand dollars [($60,000.00)] ($100,000.00), the competitive bidding for such purchase or contract shall be conducted in accordance with such procedures as council by ordinance prescribes.

(4) If any purchase or contract for which competitive bidding is required involves an expenditure of [more than sixty] one hundred thousand dollars [($60,000.00)] ($100,000.00) or more, the following procedure shall be applicable:
