AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO STUDENT LOANS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §1108, Title 14 of the Delaware Code by designating the existing text as subsection (a) with paragraphs (1) through (7) and by adding a new subsection (b) to §1108 to read:
"(b) A loan made pursuant to subsection (a) of this section may be forgiven by the Secretary of Education if the Secretary determines that the recipient is unable to meet his or her repayment obligation because of total and permanent disability or death. The Secretary may require such documents as he or she considers necessary to verify a claim of disability or death, including but not limited to a sworn affidavit from a qualified physician or a death certificate. Notwithstanding any provision to the contrary in this chapter, the Department of Education may promulgate rules and regulations to implement this subsection.".
Section 2. Amend §3418(j) of Title 14 of the Delaware Code by striking the phrase "cancelled if the Secretary of Education, with the concurrence of the State Board of Education," as it appears in the first sentence and by substituting in lieu thereof "forgiven if the Commission".
