AN ACT TO AMEND TITLES 11 AND 29 OF THE DELAWARE CODE RELATING TO CREDIT AND DEBIT CARD RECEIPTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Chapter 5, Title 11 of the Delaware Code by inserting therein the following:

Ҥ915A. Credit and debit card transaction receipts

(a) Except as provided in subsection (b) of this section, a person who accepts credit or debit cards in exchange for goods or services shall print not more than five digits of that credit or debit card account number on the credit or debit card receipt provided to the cardholder.

(b) This section applies only to receipts that are electronically printed and does not apply to transactions in which the sole means of recording the credit or debit card number is by handwriting or by an imprint or copy of the credit or debit card.

(c) Violation of this section is an unclassified misdemeanor.”

Section 2. Amend §2517(c), Title 29, Delaware Code by inserting after “§915 of Title 11” as they appear in paragraphs (1) and (2) thereof, the following:

“, §915A of Title 11”.

Section 3. This Act is effective from and after:

(1) January 1, 2004 for any person who begins accepting payment by credit or debit card in exchange for goods or services on or after January 1, 2004.

(2) January 1, 2005 for any person who began accepting payment by credit or debit card in exchange for goods or services before January 1, 2004.
