AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO THE USE OF OTHER INDICATORS PRIOR TO MANDATORY SUMMER SCHOOL.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend §153(d)(2), Title 14 of Delaware Code by adding a new paragraph “d.” thereto as follows:

“d. Notwithstanding the requirements of paragraphs a. and b. of this subsection, a student may advance to the next grade level without attending summer school if an academic review committee composed of educators from the student’s district or charter school determines that the student has demonstrated proficient performance relative to the state content standards using evidence from other indicators approved pursuant to subsection (b) of this section.”

Section 2. Amend §153(d)(4), Title 14 of Delaware Code by adding a new paragraph “d.’ thereto as follows:

“d. Notwithstanding the requirements of paragraphs a. and b. of this subsection, a student may advance to the next grade level without attending summer school if an academic review committee composed of educators from the student’s district or charter school determines that the student has demonstrated proficient performance relative to the state content standards using evidence from other indicators approved pursuant to subsection (b) of this section.”

Section 3. Amend §153(d)(5), Title 14 of Delaware Code by adding after the word “school” and before the “.” in the second sentence therein the following:

“, unless an academic review committee composed of educators from the student’s district or charter school determines that the student has demonstrated proficient performance relative to the state content standards using evidence from other indicators pursuant to subsection (b) of this section.”

Section 4. Amend §153(d)(5), Title 14 of Delaware Code by adding after the word “student” and before the word “still” in the third sentence therein the following:

“who was required to participate in summer school”.

Section 5. Amend §153(d), Title 14 of Delaware Code by adding a new subsection “(12)” thereto as follows:

“(12) An individual student’s mandatory participation in summer school pursuant to subsections (D) (2), (d) (4), or (d) 5 of this section may not be excused on more than two occasions by the use of other indicators.”
