AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO APPEALS TO THE STATE BOARD OF EDUCATION FROM DECISIONS OF LOCAL SCHOOL BOARDS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §1058 of Title 14 of the Delaware Code by deleting the words “by certified or registered mail” in the second sentence thereof.
Section 2. Further amend §1058 of Title 14 of the Delaware code by deleting the words “The Department, with the approval of the State Board,” in the third sentence thereof and inserting in lieu thereof the words “The State Board”.
Section 3. Further amend §1058 of Title 14 of the Delaware Code by deleting the words “and the Department’s counsel” in the fourth sentence thereof.
Section 4. Further amend §1058 of Title 14 of the Delaware Code by deleting the words and punctuation “, and in such case the State Board shall set forth in writing the legal basis for such conclusion” in the fourth sentence thereof.
Section 5. This Act shall be effective upon its enactment into law.
