AN ACT TO AUTHORIZE AND APPROVE THE TRANSFER OF CERTAIN REAL PROPERTY IN SUSSEX COUNTY TO THE WOODBRIDGE SCHOOL DISTRICT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
WHEREAS, the Delaware State Police, working in concert with the Department of Administrative Services and with Sussex County, are in the process of constructing a new State Police facility in western Sussex County; and
WHEREAS, in anticipation of the completion of said facility, a portion of the current State Police facility at the intersection of US Route 13 and County Road 583, identified in the land records of Sussex County as Tax Parcel 1-31 7.00 1.00, and referred to as Troop 5, has been declared surplus by the Department of Safety and Homeland Security; and
WHEREAS, the Woodbridge School District is in need of facilities to house its central office operations and has expressed an interest in acquiring title to the current Troop 5 facility; and
WHEREAS, the General Assembly deems it advisable that the State transfer a portion of the land and improvements to the Woodbridge School District for the foregoing purposes; and
WHEREAS, both parties understand and acknowledge that the State shall retain title to a portion of the property, consisting of approximately two (2) acres, which includes the radio repair shack and the 800 MHz tower, and may also wish to retain access to and the use of the gasoline filling pumps at the site.
NOW THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Notwithstanding any provisions to the contrary, including those contained in Chapter 94, Title 29 of the Delaware Code, the transfer and conveyance of a portion of State-owned property situated at US Route 13 and County Road 583, in Sussex County, and identified as Tax Parcel No. 1-31 7.00 1.00 to the Woodbridge School District, for the consideration of One Dollar ($1.00) is specifically approved.
Section 2. The parcel to be conveyed shall consist of approximately three (3) acres together with the former Troop 5 building and improvements. The Woodbridge School District will bear all expenses of engineering, subdivision, and conveying, and shall accept the property in its present “as-is” condition.
Section 3. The Department of Administrative Services is authorized and empowered to assist the Department of Safety and Homeland Security and the Woodbridge School District in identifying and describing a satisfactory portion of the property; and in determining a schedule for the conveyance satisfactory to the parties; and to prepare, have executed, and deliver to the Woodbridge School District a good and sufficient deed to the said real property.
Section 4. Should the Woodbridge School District fail to move forward with development of the site as proposed within three (3) years of the date of the conveyance, the Deed shall become invalid, and title to the property shall revert to the State of Delaware.
