AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO ABOVE GROUND STORAGE TANKS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §7404A, Title 7, Delaware Code, by deleting from subsection (a), of that section, the phrase “and 7415A” and further by inserting after the phrase “7406A,”, as found in subsection (a) of §7404A, Title 7, Delaware Code, the word “and”.
Section 2. Amend §7404A, Title 7, Delaware Code, by deleting from subsection (c) of that section, the number “40,000” and replacing it with the number “20,000” and further by deleting the phrase “and 7415A” and by inserting after the phrase “7406A,” of §7404A, Title 7, Delaware Code, the word “and”.
Section 3. Amend §7404A, Title 7, Delaware Code, by adding a new subsection (d) to read as follows:
“(d) All aboveground storage tanks used solely to store diesel, kerosene or heating fuel with a capacity of greater than 19,999 gallons and less than 40,000 gallons are exempt from this chapter, with the exception of §§ 7402A, 7405A, 7406A, 7410A and 7415A of this Title.”
Section 4. Amend Section 7404A(a)(7) Title 7, Delaware Code, by deleting the phrase “§8210” and substituting in lieu thereof the phrase “§8028”.
