AN ACT TO AMEND TITLE 14 AND TITLE 29 RELATING TO LEAVE OF ABSENCE FOR MILITARY SERVICE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend Section 1327, Chapter 13, Title 14 of the Delaware Code by adding the following sentence after the first sentence of subsection (b):
“While on such leave of absence, for a period not to exceed two (2) years, the employee and his or her dependents shall continue to receive benefits provided under any applicable group health insurance plan offered by the school district, provided that the employee continues to pay any employee-share premium for such plan.”
Section 2. Amend Title 29, Chapter 51 of the Delaware Code by adding the following sentence after the first sentence of section 5105(b):
“While on such leave of absence, for a period not to exceed two (2) years, the employee and his or her dependents shall continue to receive benefits provided under the State’s group health insurance plan, provided that the employee continues to pay any employee-share premium for such plan.”
Section 3. Amend Title 29, Chapter 52 of the Delaware Code, by striking the phrase “Beginning July 1, 1994,” as it appears in the fourth sentence of section 5201(c) of Title 29, by capitalizing the word “A” that follows that phrase, and further by striking the phrase “180 days” as it appears in section 5201(c) of Title 29, and inserting in lieu thereof the phrase “two (2) years”.
