AN ACT TO AUTHORIZE AND APPROVE THE TRANSFER OF CERTAIN REAL PROPERTY IN NEW CASTLE COUNTY TO THE DELAWARE ASSOCIATION FOR THE BLIND.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):
WHEREAS, certain real property presently owned by the State adjacent to the Emily Bissell Hospital has been declared surplus by the Department of Health and Social Services; and
WHEREAS, said property, further described in the land records of New Castle County as Parcel # 08.032.00.026, and comprising approximately 15.2 acres, is also contiguous to property of the Delaware Association for the Blind, hereinafter referred to as the "Association"; and
WHEREAS, the Association has historically complemented the activities of the Department of Health and Social Services in providing valuable services to the visually impaired; and
WHEREAS, the Association is in need of additional property in order to expand its facilities and services to its clients, specifically through construction of a new dormitory facility.
NOW THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):
Section 1. Notwithstanding any provisions to the contrary, including those contained in Chapter 94, Title 29 of the Delaware Code, the transfer and conveyance of a portion of the following described property to the Delaware Association for the Blind, hereinafter referred to as "the Association", for the consideration of One Dollar ($1.00) is specifically approved:
The property described in New Castle County Deed Book Q-23, page 137, and identified as New Castle County tax parcel #08.032.00.026, being the portion of the Bissell Hospital property on the easterly side of New Port Gap Pike, in New Castle County, Delaware.
Section 2. The parcel to be conveyed shall not exceed twelve (12) acres. The Association will bear all expenses of engineering, subdivision, and conveyancing. The Association shall accept the property in its present "as-is" condition.
Section 3. The Department of Administrative Services is authorized and empowered to assist the Association in identifying and describing a satisfactory portion of the property; and to prepare, have executed, and deliver to the Association a good and sufficient deed to the said real property.
Section 4. Should the Association fail to move forward with development of the site as proposed within three years of the date of enactment of this Act, the property shall automatically revert to the State of Delaware, and the deed conveying said land shall contain a reverter provision to that effect.
