CHAPTER 358 - STATE OF DELAWARE - EXECUTIVE DEPARTMENT PROCLAMATION
Public Proclamation No. 2 Under The State Council of Defense Act, As Amended
TO: The People of the State of Delaware.
WHEREAS, under date of the twenty-second day of April, A. D. 1943, Public Proclamation No. 1 under the State Council of Defense Act, as amended, was issued proclaiming among other things "Regulations for Control of Artificial Lighting within the Coastal Dimout Area, being Kent and Sussex Counties in the State of Delaware", to become effective as of the first day of May, A. D. 1943; and
WHEREAS, under date of the twenty-seventh day of October, A. D. 1943, the Commanding General of the Eastern Defense Command of the United States ordered the suspension of the regulations governing the control of artificial lighting in the coastal dimout area within the states of New York, New Jersey and Delaware, effective as of the first day of November, A. D. 1943; and
WHEREAS, in conformity with the order of the Commanding General of the Eastern Defense Command of the United States, the State Council of Defense of the State of Delaware in meeting assembled on the first day of November, A. D. 1943, duly adopted the following resolution:
"Public Proclamation No. 1 under the State Council of Defense Act, be amended by suspending temporarily and until further notice Part II thereof for control of artificial lighting within the coastal dimout area, being Kent and Sussex Counties in the State of Delaware, to be effective at 12:01 A. M. November 1, 1943".
NOW, THEREFORE, I, Walter W. Bacon, Governor of the State of Delaware, pursuant to the provisions of the Act of the General Assembly of the State of Delaware creating the State Council of Defense, as amended, do hereby proclaim as follows:
1. That Public Proclamation No. 1 under the State Council of Defense Act, as amended, issued as and under the date aforesaid, be and the same hereby is amended as hereinafter provided.
2. That the Orders, Rules and Regulations promulgated under Part II of said Public Proclamation No. 1 relating to "Regulations for Control of Artificial Lighting within the Coastal Dimout Area, being Kent and Sussex Counties in the State of Delaware" be and the same hereby are suspended until further notice given in accordance with the provisions of the laws of the State of Delaware in that behalf.
3. That the suspension of the Orders, Rules and Regulations provided herein shall be effective from and after 12:01 A. M. the first day of November, A. D. 1943.
4. That this Proclamation of the matters herein set forth shall be deemed sufficient notice to all persons.
