CHAPTER 646.
AN ACT to authorize the Town Commissioners of the Town of New Castle to establish a Wharf Line.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
SECTION 1. That the Town Commissioners of the Town of New Castle be and they are hereby authorized and directed to establish a wharf line upon the River Delaware, in front of the Town of New Castle, and to fix and determine how far the wharves of the said town shall hereafter be built or extended into the said river, by limiting the distances or extent thereof, in feet or inches, to be computed from any certain landmarks from which it may be convenient to determine the said distance or extent, and if necessary, taking to their assistance a skillful surveyor who shall make a plot of the river front of said town, with the wharf line, aforesaid, with the distances and landmarks plainly designated thereon, which said plot, with the designation of the wharf line and distances certified under the hands of the said commissioners of the Town of New Castle for the time being, shall be recorded in the office for recording of deeds at New Castle as a public record, for the information of all whom it may concern.
SECTION 2. If any person or persons .whatsoever, at any time after such determination or limitation, shall build or extend any wharf or wharves or landing places; filled up solid from the foundation, into the aforesaid river further than by such determination or limitation they shall be allowed to do, or shall neglect or refuse to leave such .proper sluice ways in said wharves or landing places (as may be- necessary,)in the proper places thereof, according to such limitation or determination aforesaid, then every such person or persons, builder or builders, being thereof convicted, shall forfeit and pay for every, such offense the sum of five hundred dollars, ($500)- besides the costs of prosecution, one one moiety for the use of the Town of New Castle, to be paid to the town commissioners of said town, and the other moiety for the use of the person or persons who shall sue for the same; and any such wharf extended, beyond the limitation fixed as aforesaid may and shall be abated and removed by the town commissioners aforesaid for the time being.
