COURT OF GENERAL SESSIONS

AN ACT to Amend Chapter 115 of the Revised Code of the State of Delaware, in relation to the power to take, enter and satisfy recognizances.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section I. That Chapter 115 of the Revised Code of Delaware be and the same is hereby amended by repealing 3799 Section 2 and inserting in lieu thereof the following, which shall be styled "3799 Sec. 2 :"

3799. Sec. 2. RECOGNIZANCES; POWER TO TAKE; RECORD Recognizances OF DEFAULTS; RECOVERY OF FORFEITURE: The judges of the said Court shall severally have power, in or out of sessions, to take all manner of recognizances and obligations to the Power to take State; and in case any person shall forfeit his recognizance of the peace, behavior, or appearance, the said Judges shall make a record of such default, or forfeiture, and issue scire facias, or other process, for the recovery of the forfeiture. The faults judges of said Court shall also severally have power, in or out of sessions, to order the Attorney General to satisfy the judgment obtained upon any forfeited recognizance of the peace, behavior, or appearance, whenever it shall appear to Recovery of such judge or judges that the person or persons for whose forfeiture keeping of the peace, behavior, or appearance said recognizance had been given, was or had been apprehended after the forfeiture of said recognizance, and his case disposed of by the public authorities having jurisdiction thereof, or whenever such judge or judges have presented to them such facts or conditions as, in his or their discretion, would warrant him or them in ordering the satisfaction of such judgment. When such order is made, the defendant in the judgment shall pay costs the costs thereof.
