FREE SCHOOLS
AN ACT to require the Display of the American Flag in Public Schools of the State. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That it shall be the duty of the State Board of Education to procure American Flags for each and every free public school in the State of Delaware and cause the same to be displayed in each and every school house in this State, during school hours.
Section 2. In the opening exercises of each and every free public school each morning, the teachers and pupils so assembled shall salute and pledge allegiance to the American flag as follows: "I pledge allegiance to the flag of the United States and the republic for which it stands. One nation indivisible with liberty and justice for all."
Section 3. When the State Board of Education has procured and distributed American flags in each and every free public school, any principal or teacher of such free public school who shall fail to require such salutation and pledge as hereinbefore set out shall, upon conviction for such breach, be deemed guilty of a misdemeanor and fined not more than Fifty Dollars ($50.00) or imprisoned for a term not exceeding ten days.
Section 4. The State Board of Education is hereby authorized and directed to make drafts by warrants upon the State Treasurer from funds not otherwise appropriated, such sums as shall be necessary to carry into full effect the provisions of this act.
