CHAPTER 110

GENERAL ELECTIONS

AN ACT to amend Chapter 60 of the Revised Code of the State of Delaware relating to the General Election. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That Chapter 60 of the Revised Code of the State of Delaware be and the same is hereby amended by the repeal of the second paragraph of 1770, Sec. 50, thereof, and inserting in lieu thereof the following to be known as the second paragraph of 1770, Sec.-50: If any envelope should be found to contain more than one ballot, none of the ballots contained in that envelope shall be counted. The Election Officers shall also record on the tally list memoranda of such ballots and envelopes and the condition of the seal of the envelope packages and in any contest of election, such ballot, envelope and seals may be submitted in evidence. Immediately on closing the polls, the envelopes remaining unused shall be counted and those envelopes on which the Clerks of Election shall have written their names and remaining unused shall be destroyed by the Election Officers of the several Election Districts by totally consuming by fire. The envelopes remaining unused upon which the Clerks of Election shall not have written their names, shall be returned to the respective Clerks of the Peace in the manner hereinafter provided and the Election Officers shall certify the number of envelopes so destroyed and the number of envelopes so returned on the respective tally lists.

Section 2. That Chapter 60 of the Revised Code of the State of Delaware be and the same is hereby further amended by adding to the end of 1783, Sec. 62 thereof, the following: Each inspector or other officer authorized by law to hold the election shall also on the day next after the General Election, de- liver into the office of the said Clerk of the Peace in his County, all unused paraphernalia and supplies not required by law to be destroyed including envelopes, rubber bands, pencils, rubber stamps, pads, blank forms and bibles, required to be furnished to him by law to be used in connection with such election, and the said Clerks of the Peace shall severally keep and preserve such paraphernalia and supplies so returned and all other unused paraphernalia and supplies in their hands and possession for use at the next or succeeding General Election or elections so far as the same shall be practicable and appropriate.

Section 3. That Chapter 60 of the Revised Code of the State of Delaware, be and the same is hereby further amended by adding thereto a new Section to be known as 1815 A, Sec. 95 A. 1815 A. Sec. 95 A. All paraphernalia and supplies furnished to the inspectors or other officers authorized by law to hold the election shall be prepared, so far as practicable, in such a manner so that such paraphernalia and supplies as are not used at such election or thereafter by law destroyed, can be used at the next or succeeding General Election or elections and the officers and departments required by law to furnish such paraphernalia and supplies shall use such paraphernalia and supplies as have theretofore been returned to and as are otherwise in the hands and possession of the respective Clerks of the Peace, and the said officers and departments required by law to furnish such paraphernalia and supplies shall only purchase or con- tract for the amount of such paraphernalia and supplies as are required by law in excess of such amount so returned to and otherwise in the hands and possession of the respective Clerks of the Peace.
