CHAPTER 212

SUPERIOR COURT

AN ACT to amend Chapter 112 of the Revised Code of Delaware relating to the Superior Court.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

That Section 5 of Chapter 112 of the Revised Code of 1915, being Section 3729 of said Code, be and the same is hereby repealed and the following inserted in lieu thereof: 3729.

Section 5. The Judges who give any interlocutory judgment, shall, on motion, make an order, in the nature of a writ of inquiry, to charge the jury attending at the same, or next Court, to inquire in open Court, of the damages and costs sustained by the plaintiff in such action, and return their inquisition; whereupon the Court may proceed to judgment.
