Section 1. Amend §904 of Title 4 of the Delaware Code by adding a new subsection “(o)” to read as follows:
“(o) Nothing in this section shall prohibit or prevent persons at least 18 years of age and under the age of 21 from entering in a premises licensed as a tavern or taproom for the purpose of a concert or music event, provided that the premises licensed as a tavern or taproom is arranged such that all persons under 21 years shall be segregated on a different floor or in a different room which has its own separate entrances and exits to the outside of such licensed premises; and in either case, that during any such concert or music event, no alcoholic liquor shall be sold, furnished or given to any person under the age of 21 years at any time before, during or after the concert or music event. All alcoholic liquor must be either removed from or placed under lock and key in the area of the licensed premises to be occupied by persons under 21 years at all times during the concert or music event and any time before or after the concert or music event when persons under the age of 21 years are present in that area of the licensed premises. Prior to permitting underage persons into a tavern or taproom pursuant to this subsection, the licensed tavern or taproom shall file an application with the Commissioner, give notice in accordance with §524 of this Title, and obtain the approval of the Commissioner.”
Section 2. This Act shall expire three years after enactment.
