AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO PUBLIC ATTENDANCE OF HOMELESS CHILDREN AND UNACCOMPANIED YOUTH.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §202(c), Title 14 of the Delaware Code by adding a new sentence at the end thereof as follows:
“Notwithstanding the foregoing, homeless children and unaccompanied youth, as defined by 42 U.S.C. §11434(a), shall attend school in accordance with the provisions of The McKinney-Vento Homeless Education Assistance Improvement Act; provided any person determined to be ineligible under the Act may be denied enrollment.”.
Section 2. This Bill shall become effective upon enactment into law.
