CHAPTER 51

STATE BOARD OF AGRICULTURE

AN ACT to Amend Chapter 21 of the Revised Code of the State of Delaware in reference to the State Board of Agriculture.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

That Chapter 21 of the Revised Code of the State of Delaware as heretofore amended be and the same is hereby amended by adding thereto the following new Sections to be styled 697K, Section 48K, and 697L, Section 48L.

697K. Section 48K. That for the encouragement of the breeding of better poultry in Delaware and for the improvement in the quality of hatching eggs from farm flocks and chicks from the hatcheries of the State, the State Board of Agriculture is hereby given the authority to have inspections made of poultry flocks and chick hatcheries in the State of Delaware upon application of the owners thereof and to make rules for such inspections. When such State inspection shows freedom from disease and the meeting of standards for poultry flocks and chick hatcheries, which standards the State Board of Agriculture is hereby given authority to establish, the said issue Board may issue certificates to the said owners showing that certificates the said standards have been met. When hatcheries in this State use for hatching purposes eggs from flocks of poultry accredited as aforesaid, such hatcheries, upon meeting other rules and regulations of the State Board of Agriculture shall be called "Certified Hatcheries" and the owners thereof shall Certified Hatcheries have the right to use on their containers in which chicks are shipped or distributed labels showing that the chicks so shipped or distributed have come from "Accredited Flocks" and "Certified Hatcheries" as above defined. The State Board of Agriculture alone shall have the authority to have such labels printed and distributed.

697L. Section 48L. The State Board of Agriculture may revoke certificates issued in accordance with the foregoing section when the rules, regulations and requirements, made for "Accredited Flocks" of poultry and "Certified Use of "au. Hatcheries" are not complied with by the owners of such flocks and hatcheries. Any person using labels of the kind named misdemeanor in the foregoing Section without the authority of the State Board of Agriculture shall be guilty of a misdemeanor and upon indictment and conviction in the Court of General Sessions shall be punished by fine or imprisonment in the Penalty discretion of the Court.
