AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO BUSINESS TAX CREDITS AND LICENSE FEE REDUCTION.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend section 2020(1) of Title 30 of the Delaware Code by striking the year “1980” wherever it appears and substituting in lieu thereof the year “1990”.

Section 2. Amend section 2020(1)d. of Title 30 of the Delaware Code as follows:

(a) strike the reference to “006.01, 006.02, 007, 009, 015, 016, 017, 019, 021 and 022” where it appears and substitute in lieu thereof “001, 006.01, 006.02, 007, 008, 009, 016, 017, 019 and 020”;

(b) strike the reference to “107, 122, 124, 129, 137, 151, 155, 162, 165 and 167” where it appears and substitute in lieu thereof “101.1, 107, 128, 129, 145.02, 153, 154, 155, 162 and 167”;

(c) strike the reference to “406, 414, 425, 428 and 429” where it appears and substitute in lieu thereof “408, 410, 414, 425 and 430”; and,

(d) strike the reference to “502, 508, 514, 515 and 518” where it appears and substitute in lieu thereof the numerals “504, 506, 514, 518 and 519”.

Section 3. Amend section 2020(1)e. of Title 30 of the Delaware Code by striking the year “1990” where it appears and substituting in lieu thereof the year “2000”.

Section 4. If any provision of this Act or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to that end, the provisions of this Act are declared to be severable.

Section 5. This Act shall be effective with respect to property placed in service after December 31, 2003.
